These Terms of Service ("Terms") govern your access to and use of the websites arboreals.xyz and airboreals.xyz (the "Site"), and any non-fungible tokens (NFTs), memberships, or other products (digital or physical) offered by KAS1976 LLC ("we," "us," or "our"). By accessing the Site or purchasing a product, you agree to be bound by these Terms.

PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, INCLUDING A WAIVER OF CLASS ACTIONS AND A BINDING ARBITRATION CLAUSE.

1. The Arboreals Project

The AI-Rboreal collection is a project of KAS1976 LLC. We provide access to digital collectibles (NFTs), memberships to digital and in-real-life (IRL) communities for artists and innovators, and a digital hub focused on gaming, experimental art, collaboration, and high-end merchandise ("Services").

2. Eligibility and Use

You must be at least 18 years old to use our Services. You are responsible for ensuring your use of the Services complies with all laws, rules, and regulations applicable to you. Access to our Services may be restricted in certain jurisdictions ("Local Use Restrictions").

3. Payments and Purchases

We may use third-party payment processors, such as MoonPay, to facilitate transactions. You agree to abide by the terms and conditions of any such third-party processor. You are responsible for all applicable taxes and fees.

4. Refund Policy

• Digital Products (NFTs, Memberships): All sales of digital products are final. Due to the nature of digital assets and blockchain transactions, we do not offer any refunds or returns for NFTs or digital memberships once a purchase is complete.
• Physical Products (Merchandise): Returns and refunds for physical products, if offered, will vary by product. The specific return, refund, and warranty policy for any physical item will be clearly disclosed on its product page at the time of purchase.

5. Shipping and Availability (Physical Products)

For any physical products, shipping may not be available to all locations worldwide due to regulations, customs, or carrier limitations. We reserve the right to cancel any orders for physical products that cannot be shipped to your location, in which case a full refund for that item will be issued.

6. Intellectual Property

When you purchase an AI-Rboreal NFT, you own the underlying token on the blockchain. We grant you a limited, worldwide, royalty-free license to use, copy, and display the art associated with your NFT for personal, non-commercial use. Specific license terms may vary by collection and will be detailed at the time of mint. We retain all rights, title, and interest in the AI-Rboreals brand and intellectual property.

7. Disclaimers

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. THE VALUE OF NFTS IS SUBJECTIVE AND VOLATILE, AND WE CANNOT GUARANTEE THEIR VALUE. YOU ACKNOWLEDGE THE RISKS ASSOCIATED WITH CRYPTOCURRENCY AND BLOCKCHAIN TECHNOLOGY.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KAS1976 LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.
